These Terms of Use ("Terms") govern your use of notyourscore.com (the "Site"), operated by The Etcetera Companies LLC, doing business as Not Your Score ("Not Your Score," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. What we do
The Site lets you submit information so we can match you with third-party lenders and marketing partners who may contact you about loan and related financial options. We do not charge you for this service. We do not control, and are not responsible for, the products, rates, terms, decisions, or conduct of any third-party lender or partner.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and your own.
3. Consent to be contacted
When you submit a form and agree to our consent disclosure, you authorize Not Your Score and its lenders and marketing partners to contact you at the phone number and email you provide, by the methods described in that disclosure. Consent is not a condition of obtaining any loan, product, or service. You may revoke consent at any time as described in our Privacy Policy.
4. Your responsibilities
You agree to provide accurate information, to use the Site only for lawful purposes, and not to misuse the Site — including by submitting another person's information without authorization, attempting to gain unauthorized access, interfering with the Site's operation or security, or transmitting harmful code.
5. Intellectual property
The Site and its contents — text, graphics, logos, and design — are owned by or licensed to The Etcetera Companies LLC and are protected by intellectual-property laws. "Not Your Score" is a trade name of The Etcetera Companies LLC. You may view the Site for personal, non-commercial purposes; you may not copy, reproduce, republish, or distribute its contents without our prior written consent.
6. Third-party links and services
The Site links to and works with third-party lenders, partners, and websites. We are not responsible for the content, policies, products, or practices of any third party. Your dealings with any third party are solely between you and that party, and are governed by their terms and privacy policies.
7. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, that any lender will contact you, or that you will be matched, approved, or offered any particular rate or term.
8. Limitation of liability
To the fullest extent permitted by law, The Etcetera Companies LLC and its members, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site or your dealings with any third-party lender or partner, even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless The Etcetera Companies LLC from any claims, damages, liabilities, and expenses arising out of your use of the Site or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, unless otherwise required by applicable law.
11. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will revise the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
